Normalization of Facts in the Legal System

  • While the legal system is a normative system in nature, it is also a system of facts. The integration of facts and norms in the legal system is largely determined by the capability of human beings in understanding the real world. There has been an obvious improvement of integrating facts and norms in the legal system from agricultural era to now because human beings are much more capable of understanding the real world than before. As a result, the legal system is much more scientific than before also. Having said that, we also have to recognize that human beings are still striving to understand the real world systematically and completely. Hopefully, the undergoing information revolution will bring about a paradigm revolution in social research, with the adoption of big data analysis in legal research, and probably will also contribute to a brand-new type of legal system where facts and norms are highly integrated.

        Normalization of Facts in the Legal System

        Abstract: While the legal system is a normative system in nature, it is also a system of facts. The integration of facts and norms in the legal system is largely determined by the capability of human beings in understanding the real world.
